LIMUSA statement on conciliation outcomes of the case brought by our President against his employer.

The Liberated Metalworkers Union of South Africa (Limusa) is vindicated by the conciliation outcomes of the case that was brought to the Commission for Conciliation, Mediation and Arbitration (CCMA) by our President, comrade Siboniso Mdletshe. On the 9th September 2015, comrade Mdletshe was summarily suspended by his employer, ABB. The company alleged that he committed gross misconduct by submitting union membership forms to ABB instead of submitting them to a supplier company and further alleged that he encouraged workers from these supplier companies to join LIMUSA and therefore could not be trusted
by the company (ABB). He was later dismissed on these charges even after appealing.

Comrade Mdletshe brought the case to the CCMA and yesterday, was vindicated when the company proposed a monetary settlement whilst comrade Mdletshe wanted to be reinstated. The proposal for a monetary settlement is an admission of guilt by ABB. It is an admission of guilt in a sense that the company acknowledges that it trampled on comrade Mdletshe’s constitutional rights by dismissing him on manufactured charges.

When the conciliation efforts deadlocked and the matter was referred for arbitration, ABB persuaded LIMUSA to engage on the sidelines as it feels that arbitration will be unfavourable to them.

We believe that the proposal for monetary settlement is nothing but an attempt to keep LIMUSA, through its President, out of ABB. Such companies will try by all means necessary to scare workers into submission by targeting leaders of progressive trade unions; comrade Mdletshe is a case in point.

LIMUSA has proven to be a threat to employers across South Africa and even when its members have been wrongly dismissed, employers will fight tooth and nail not to reinstate them. They would rather sacrifice a portion of their profits than to have organized workers, especially workers who are organized by a fighting union that is LIMUSA.

We call on our members to remain persistent and resolute in the fight against unfair labour practises. This battle might be a certain victory, but the war against rogue employers who continue to exploit, casualise and underpay workers is far from the end!
